Terms of Service
The agreement between you and ElevAIte for using ElevAIte Voice.

1. Who we are and what this covers
ElevAIte Voice (the “Service”) is an AI calling product operated by ElevAIte (“ElevAIte”, “we”, “us”). These Terms, together with our Privacy Policy, Acceptable Use Policy and Refund Policy, form the agreement between you and us. By creating an account, signing in, or using the Service you agree to them. If you use the Service for a business, you confirm you can bind that business.
The Service is in beta. It is provided “as is” and “as available”, and features, languages, prices and limits may change. We will not change what you have already paid for.
2. Your account
You must be at least 18 and give us accurate details: your name, a working email, a phone number, your company if any, and your country. Keep them up to date. You are responsible for everything done through your account and for keeping your password and any API keys secret. Tell us at once if you think your account has been misused.
One free trial is given per person and per phone number. Creating several accounts to get more free minutes is not allowed.
3. What the Service does
The Service lets you set up AI voice agents that place outbound phone calls to people you choose, hold a conversation, record and transcribe the call, summarise it, and send results to your tools. The voices, speech, language and telephony are provided by third parties we work with, so quality and availability can vary.
AI can make mistakes, mishear, misspeak or say things you did not intend. You must test your agent before using it with real leads and review its calls.
4. You decide who is called. You are responsible for it
ElevAIte is a technology provider. You, not ElevAIte, choose the people called, the numbers, the timing, and what your agent is told to say. You are solely responsible for having a lawful basis and valid consent for every call and every recording, for telling people they are speaking to an AI, for honouring do-not-call requests, and for following every law and regulation that applies to your calls and your leads, including (as relevant) India's Digital Personal Data Protection Act 2023 and TRAI telecom commercial communications rules, the US Telephone Consumer Protection Act and FCC rules, and the UK's Privacy and Electronic Communications Regulations and UK GDPR.
United States: the FCC treats AI-generated voices as “artificial” voices under the TCPA, so marketing calls or texts to mobile numbers using them generally need the called person's prior express written consent, and calls must honour the National Do Not Call Registry, state do-not-call lists, calling-time limits (8am to 9pm local time) and caller-ID rules. Some states have their own telemarketing and call-recording laws. You are responsible for knowing and following them.
Our tools help, for example by requiring a consent flag, announcing the call is from an AI assistant, keeping a do-not-call list and respecting calling hours, but they do not make a call lawful. We do not give legal advice.
ElevAIte is not responsible or liable for how you or your leads use the Service, for the content of your agents' scripts, for any complaint, claim, penalty or fine arising from your calls, or for the accuracy of anything an AI agent says.
5. Acceptable use
You must follow the Acceptable Use Policy. We monitor usage with automated checks for signs of misuse, such as bursts of calls, calling many numbers, calls dropped at once and repeated requests to stop. We may pause calling, limit, suspend or ban an account, investigate it, and keep the records we need, with or without notice where we think it is necessary to protect people, the Service or ourselves.
6. Prices, payment and tax
Prices are shown before tax. Customers in India pay in rupees plus GST, customers in the United Kingdom pay in pounds, and others pay in US dollars. Payments are processed by Razorpay. We do not store your card details. Minutes are charged per started minute of talk time. Calls nobody answers are not charged. Calls to some countries use more minutes per minute.
Plans renew only when you pay again. Pay-as-you-go balances are used in the order bought. If you run out of minutes, calls stop. We give a tax invoice for every payment. Refunds are covered in the Refund Policy.
7. Your data and recordings
You own your data. You give us permission to process it only to run the Service for you. For the personal data of the people you call, you are the controller or data fiduciary and we act as your processor. Our Privacy Policy explains what we collect, who helps us process it, and your rights. You are responsible for the notices and consents your callers are owed, including for recording.
8. Third-party services
The Service depends on providers such as ElevenLabs, Twilio, OpenAI, Razorpay, Google, Resend and your CRM. We are not responsible for their outages, changes or acts. Your use of your own CRM or other tools is under their terms.
9. Our property
We and our licensors own the Service, its software, brand and content. You get a limited, non-exclusive, non-transferable right to use it under these Terms. You may not copy it, resell it, reverse engineer it, or use it to build a competing product.
10. No warranty
To the fullest extent the law allows, the Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, uninterrupted or error-free operation, and that calls will connect or be answered.
11. Limits on our liability
To the fullest extent the law allows, ElevAIte and its team are not liable for indirect, incidental, special, consequential or punitive loss, or for lost profit, revenue, goodwill or data, or for any claim, fine or penalty brought by a person you called or by a regulator because of your calls. Our total liability to you for any claim about the Service is limited to the amount you paid us in the three months before the event. Nothing in these Terms limits liability that cannot lawfully be limited.
12. You protect us
You agree to defend and compensate ElevAIte, its team and partners against claims, losses, fines and costs (including reasonable legal fees) that arise from your calls, your content and scripts, your leads' data, your breach of these Terms or the Acceptable Use Policy, or your breach of law.
13. Suspension and ending
You can stop using the Service and close your account at any time. We can suspend or end your access immediately if you breach these Terms or the Acceptable Use Policy, if we suspect misuse or fraud, if the law requires it, or if you do not pay. If we end your account for a breach, we are not required to refund unused minutes. We may share information with authorities where the law requires or allows it.
14. Changes
We may update these Terms. We will post the new version here with its date and, for material changes, tell you in the app or by email. Using the Service after a change means you accept it.
15. Law and disputes
These Terms are governed by the laws of India. Courts in India have exclusive jurisdiction, except where the law of your country gives you rights that cannot be waived. Please write to us first at connect@elevaite.in so we can try to resolve any issue informally.
